"I want to make an application to remove obstruction"
Says Marian Perrott
Here's the latest of my submissions to IWC, which was the 2-month anniversary of service of the Sec.130A notice. It was sent with notification of my intention to make an application to the Magistrates Court for an Order to remove the obstruction.
I have to wait 5 days before making the application, so we'll see if anything changes in the interim period. If not, I think that as long as my solicitor is confident about my argument, I'm going to instruct him to go for it and force the Council to justify themselves.
It'll be interesting to see if they go ahead with surface dressing it regardless – I'm awaiting a copy of their works-related insurance certificate, having asked for it to be supplied before the start of works...now it's just a question of sitting back and waiting!
