Application has been made to have yateley common de-registered on the grounds that the applicants claim to be owners and that they believe that they are qualified to make such an application under s19 of the commons act 2006

For this i need to see documentary evidence of ownership  - for this i make an application that all documents are disclosed for examinatin by an independent conveyance solicitor.  A letter from the grantor to the leaseholder is not satisfactory evidence

The applicants are claiming wrongful registration of the common land cl24 – i would refer you to the commons commissioner baden-fullers decision made 26 march, 1974 where you will see that this is incorrect and that the land was registered correctly as common land

All councils would have been informed of decisions with regard to the registration of common land within their area in 1965 and 1974 – as highlighted in the decision.

The planning inspectorate and hampshire county council - you being ther commons registration authority for the registration of yateley common cl24 – are fully aware of the final decision of commons commisioner mr. Baden-fuller.  I have a copy of the summary of his decision, should you need it.

Paragraph 6, schedule 2 of the 2006 commons act is obsolete as the common land was never provisionally registered

The applicant has no jurisdiction and i am challenging them for full disclosure before this can proceed any further.

Commons commissioner said there isn't a blackbushe part of yateley common, he refused to accept sir richards claim.

Demand before any further meetings or goings on  documents relating to ownership must be disclosed

I request disclosure of the lease agreement document which will include the details of the lease
I also request disclosure of the particulars of the grantor's title deeds

Commons commissioner decision – headed decision - 26th march, 1974
The whole of yateley common (including the part known as blackbushe airport) was properly registered as common land

It was never provisionally registered

18th july, 2017 – provisional and final registration dates amended to "accurately" reflect the dates recorded in the land section of hampshire countil council's register of common land

It was registered as common land without an owner (subject to section 9 of the 1965 registration act) the land was "vested" in to the protection of the local authorities without any jurisdiction,

Evidence of s19 of the 2006 commons act – you cannot use this as the common land was correctly registered in 1965 and made conclusive by section 10 of the registration as matter registered

Where is your evidence - documentation evidence  to show its demesne land of the lordships' estate – 

Other manorial waste – yateley common is not subject to anyone as no one has any jurisdiction on this land, councils are custodians only
