Tony Barnett writes to the BHS
IF THE BHS IS DEMOCRATIC AND HOLDS A CHARITABLE POSITION,
WOULD THIS BE A LAWFUL PROCESS?

I HAVE READ THE PROFILES OF THE PERSONS APPLYING FOR THE POSITION OF TRUSTEES AT BHS, MAY I ASK IF THESE ARE THROUGH THE PROCESS OF ELIMINATION BY THE HIERARCHY AT BHS?
IT HAS COME TO BE KNOWN THAT MORE THAN THE LIST OF APPLICANTS AS SEEN ON HORSEYTALK SHOWED GREAT INTEREST IN THE POSITIONS.
IF THE BHS IS DEMOCRATIC AND HOLDS A CHARITABLE POSITION, WOULD THIS BE A LAWFUL PROCESS?
IT HAS ALSO BEEN STATED THAT THE BRONZE MEMBERSHIP COULD BE EXTINGUISHED AS IT HAS NO RIGHTS TO VOTE OR TO HOLD ANY POSITION IN BHS OTHER THAN A SUPPORTER.
THE APPLICATIONS SHOWN ARE FROM MEMBERS OF BHS THAT HAVE GOOD CV's IN HORSE MANAGMENT ETC. BUT NONE SHOW ANY EXPERTISE IN THE LEGISLATION ON LAWFUL ACCESS TO ANY OPEN ACCESS LANDS.
RIGHTS OF ACCESS ARE BEING STOLEN, THIS NEEDS STRONG EXAMINATION BY THE ELECTED AND THE HIERARCHY THROUGH THE PROCESS PROVIDED THROUGH LEGISLATION.
INSURANCE COVER BY THE PERSONS INVITING ACCESS THROUGH UNLAWFULLY PLACED IMPEDIMENTS AND LAWFULLY PLACED OBSTRUCTIONS IS NOT, IT SEEMS, TO BE OF ANY INTEREST TO BHS, SO WHY THE GOLD AND SILVER MEMBERSHIP THAT OFFERS INSURANCE COVER.
OPEN ACCESS LAND ARE AS OF RIGHT, NO INVITE IS REQUIRED OR LAWFUL, YET THIS INFORMATION HAS NOT BEEN PROVIDED TO ANY BHS MEMBER, IN ESSENCE ACCESS TO COMMON LAND AND OTHER ANCIENT RIGHTS OF WAY CARRIES NO PUBLIC LIABILITY BY "OWNERS OR COMMONERS" IF ANY.
THIS IS WHERE BHS SHOULD HAVE AN OFFICER AT HEADQUARTERS TO DEAL WITH THIS SITUATION, INSTEAD OF LEAVING IT TO THE COULDN'T CARE LESS ACCESS VOLUNTEERS.
BHS HAS BEEN ASKED TO SUPPORT ONE ACCESS OFFICER THAT DOES TAKE THE ACCESS OFFICER'S ROLE SERIOUSLY BY TAKING ACTION UNDER LEGISLATIVE POWERS, BUT HAS NO STOMACH FOR IT OR HAS THE SUPPORT FROM THE CEO AND CHAIR, MAUREEN COMBER IS THE PERSON, FOR HER TROUBLES SHE HAS BEEN REPREMANDED BY THE HIERARCHY FOR NOT BEING DIPLOMATIC WITH HCC COUNCIL.
HOWEVER, I WILL SUPPORT THE ACTION UNDER SECTION 41 IN THE COURTS WITH THE BHS ACCESS OFFICER.
IT WOULD BE BENEFICAL TO THE BHS TO CREATE A POSITION FOR THIS PURPOSE.

On page 11 and 41 of your March/April British Horse magazine, you will find the full details of how we take nominations for the positions of Trustees at the BHS . All nominations that are received and meet the requirements of nominations (for example are received with five signatures, names and membership numbers of voting members of the Society) and that arrive by the closing date are put forward to the election. There is no process of elimination if they meet the criteria set out. This is a lawful process.
Historically our Bronze membership has never had rights to vote but we are currently reviewing all our membership packages to ensure our products are more relevant to our audience groups eg Owners, Riders, Children, Professionals and Enthusiasts.
